Anthropic has privately presented US lawmakers with a draft bill to regulate the safety and security of advanced artificial intelligence systems, Politico reported on Friday.

According to the report, the proposal sets a high threshold for government intervention, allowing authorities to seek a halt to a model’s release or use only if it poses a foreseeable and imminent risk of causing more than $1 billion in damage, or killing or seriously injuring more than 50 people.

The risks covered by the draft include the creation or release of a biological weapon, an AI model evading its developer’s controls, or a cyberattack.

The draft would require independent evaluators to assess AI developers and their most advanced models periodically.

The evaluators would register with the US Department of Commerce, while AI companies would be permitted to pay for assessments provided the payments were not tied to their outcomes.

Evaluators identifying an imminent risk covered by the proposed legislation would have to notify the Commerce Department within 72 hours of completing their assessment, according to the report.

The department could then ask a federal judge in the US District Court for the District of Columbia to suspend a model’s release or use. The proposed framework would bar other federal departments, agencies and officials from independently suspending AI development, deployment or internal use.

Anthropic seeks defined limits on government intervention

The proposal reflects Anthropic’s effort to establish a regulatory framework for frontier AI systems, while setting specific conditions under which the government could intervene in their deployment.

An Anthropic spokesperson said the draft builds on the company’s Advanced AI Framework and is intended to give the government the ability to block or deter dangerous deployments of the most powerful models.

The proposal comes amid broader debate in Washington over safeguards for increasingly capable AI systems and the extent of government oversight.
